Terms of Service: Black Friday Cybersecurity Special

Effective Date:

This Terms of Service agreement is effective as of November 18, 2024.

Overview:

This agreement governs the use of the Black Friday Cybersecurity Special for continuous penetration testing offered by iFlock Security Consulting, LLC (“iFlock,” “we,” “us,” or “our”). These terms apply exclusively to this product and special offering and do not replace or override the overall Terms of Service for the iFlock website or other services. Instead, they are an addition to those terms.

By purchasing this service, the customer (“you” or “your”) agrees to the following terms and conditions.

Scope of Services:

• Continuous Penetration Testing:
  • • • • Testing is powered by NodeZero technology from Horizon3.
      • Each test is limited to a maximum duration of 2 hours.
      • No more than one test per week is permitted.
  • There may be instances where testing jobs queue due to system availability.
• Types of Testing:
  • Penetration testing is limited to internal and external network penetration testing only.
  • Scoping: The scope of the penetration tests is determined by the customer.
    • Customers are responsible for providing accurate and complete scoping information.
    • Any errors or omissions in scope are solely the responsibility of the customer.
  • Scope Changes: Customers may modify the scope of penetration tests as needed.
  • Authorization: The customer must own or have explicit authorization to test all assets included in the scope.
• Service Term:
  • This offer is valid until December 6, 2024 and applies to one year of service from the date of purchase.
• Support:
  • Support is provided via a dedicated account representative or through support@iflockconsulting.com.

Customer Acknowledgments:

• Responsibility for Vulnerabilities: iFlock will identify vulnerabilities through penetration testing. We do not remediate or fix any vulnerabilities discovered. Customers are solely responsible for addressing vulnerabilities identified during testing.
• Risk of Outages: Customer acknowledges that penetration testing involves inherent risks, including potential network outages or interruptions. By purchasing this service, the customer agrees to accept the risk of outages and releases iFlock from any liability related to such occurrences.
• Job Queuing: Testing jobs are subject to scheduling and system availability. Customers agree that delays due to queuing may occur.
• Warranty Disclaimer:
  • iFlock does not provide any warranty, express or implied, for the NodeZero technology from Horizon3.
  • iFlock makes no claims regarding the reliability, effectiveness, or impact of NodeZero on your environment.
  • iFlock does not guarantee the effectiveness, reliability, or success of the continuous penetration testing service.
• Marketing Consent: By purchasing this service, the customer agrees to be contacted by iFlock Security Consulting, LLC regarding additional services, promotions, and offerings.

Limitations of Liability:

• iFlock is not liable for any:
  • Outages, service interruptions, or other impacts on the network during or after penetration testing.
  • Losses or damages resulting from vulnerabilities identified during testing.
  • Errors in the scope of testing caused by incomplete or inaccurate information provided by the customer.
• The maximum liability of iFlock under this agreement shall not exceed the amount paid for the service.

Customer Obligations:

• Ensure that all systems and networks to be tested are appropriately configured for penetration testing.
• Provide accurate and complete scoping information for the tests.
• Take necessary precautions to minimize the impact of any network disruptions during testing.
• Confirm ownership or obtain explicit authorization to test all items included in the scope.

Termination:

This agreement will terminate after one year of service or upon breach of any terms by the customer. iFlock reserves the right to terminate services at its discretion.

Refund Policy:

The Black Friday Cybersecurity Special is non-refundable once purchased.

Miscellaneous:

• Governing Law: This agreement is governed by the laws of the State of Indiana.
• Amendments: iFlock reserves the right to amend these terms at any time. Changes will be communicated in writing to the customer.
• No Guarantees: iFlock makes no guarantees, implied, written, or otherwise, regarding the effectiveness or reliability of the continuous penetration testing service.
• Exclusive Application: These terms apply only to the Black Friday Cybersecurity Special and do not extend to any other services or offerings by iFlock Security Consulting, LLC.
• Additional Terms: These terms are in addition to and do not replace or override the general Terms of Service for the iFlock website or other services.
